The 835 lists methods of moving payments to providers. These include paper checks, and EFT transactions. The implementation guide front matter, i.e. sections 2.1.2 - Flows – Data and Dollars, 2.1.3 – EFT, 2.2.2 – Remittance Tracking, 2.2.3 – Re-association of data and dollars - explain the process in detail. The BPR segment is very clear about the construction of the 835 when EFT is used to move cash.

Per the guide, if an ACH is created, the only options for the ACH format to be sent is CCD+ where the ACH transaction has an addenda record with the TRN segment imbedded, or the CTX format where the complete 835 flows along with the ACH transaction in the addenda.

Is a payer in compliance with the HIPAA Implementation of the 835 if they create an 835 per the instructions in the guide, BPR04 indicates ACH, but the ensuing ACH transaction is not either the CCD+ or CTX formats with the appropriate addenda data?

Without the addenda, the provider is unable to re-associate the payment to the 835.

This issue is explicitly addressed in guide 004010X091. The only values allowed by this guide to identify ACH electronic funds transfers (EFT) are CCP for a CCD+ EFT or CTX for a CTX EFT. An 835 identifying any other ACH EFT format is not compliant with this guide. The instructions are clear that the intent of the developers is that the TRN segment be sent within the ACH addenda record when using the CCD+ EFT format.

While the intent of the developers is that the actual ACH format used match that identified within the BPR segment and contain appropriate content (the TRN segment for a CCD+ EFT), compliance with that intent is a HIPAA policy issue and should be addressed to askhipaa@cms.hhs.gov.
